US toughens online privacy rules for children
WASHINGTON DC — US regulators unveiled new rules Wednesday aimed at strengthening online privacy protection for children, to reflect the growing use of mobile apps and social networks.
The Federal Trade Commission said its updated rules require online services to get consent from parents if they are aimed at children under 13 or know that they are collecting personal information from young children.
But FTC chairman Jon Leibowitz said the Children’s Online Privacy Protection Act would not include stricter proposals which would have made companies liable for “plug-ins” such as the Facebook “like” button or Twitter’s “tweet” button.
“The Commission takes seriously its mandate to protect children’s online privacy in this ever-changing technological landscape,” said Leibowitz.
“I am confident that the amendments to the COPPA Rule strike the right balance between protecting innovation that will provide rich and engaging content for children, and ensuring that parents are informed and involved in their children’s online activities.”
Leibowitz told reporters that websites will still be able to direct ads to children, and that “the only limit we place is on behavioral advertising,” which is based on a person’s browsing activity.
“Until you get parental consent, you may not build massive profiles of children to deliver advertising,” the regulator said.
The rules close some loopholes on online operators who can be liable for violations of the law, which was passed by Congress in 1998.
But the regulations note that, in light of comments received on a draft, the FTC decided the rules should not encompass platforms such as Google Play or the App Store, that offer access to “someone else’s child-directed content.”
Third-party plug-ins will be responsible only where they have “actual knowledge that they are collecting personal information from users of a child-directed site.”
Leibowitz said the FTC “struggled with this” issue and sought to avoid rules which clamped down on operators to force them to create a “sanitized” Internet for older children and adults.
“We think where we ended up was both balanced and very very strong,” he said. “We did two rounds of comments because we wanted to get it right and we wanted to listen to everybody.”
The proposal drew hundreds of comments, including some who feared Facebook could be held liable if it allowed young children to hit the “like” button without getting parental consent.
Senator Jay Rockefeller, who joined the news conference unveiling the updated rules, said they were as strong as the law allowed.
“The FTC really went as far as they could,” Rockefeller said.
“There will be groups that will complain about it and so will I. But we can’t do anything about it because the FTC is governed by law.”
Jeff Chester, executive director of the Center for Digital Democracy, which lobbies for greater privacy protections, called the FTC move “a major step forward” but warned that it may not be effective.
“We are concerned about possible loopholes that could undermine the intent of the rules,” he said, adding that his group would maintain “file complaints against any company that violates the new rules.”

Miss USA crowned Miss Universe, Miss Philippines 1st runner-up
LAS VEGAS – A 20-year-old beauty queen who plays the cello and is a breast cancer advocate was crowned Miss Universe on Wednesday, the eighth time an American has won the pageant where the world’s most beautiful women parade in bikinis and ball gowns.
Olivia Culpo, 20, a brunette from Rhode Island, was chosen by a 10-judge panel from 89 contestants representing countries ranging from India to Kosovo and Britain.
Culpo, wearing a red, long-sleeved dress for her final look, was the eighth winner from the United States in the contest’s 60-year history — the sixth to win on home soil — and the first Miss USA to take the title since 1997.
Miss Philippines, 23-year-old pharmacy graduate Janine Tugonon, was the runner-up and Miss Venezuela, Irene Sofia Esser Quintero, came third after the top five answered brief questions posed by the judges.
Culpo takes the place of last year’s winner Leila Lopes, who was the first ever Miss Universe from Angola.
Miss Guatemala, Laura Godoy, was chosen Miss Congeniality after the two-hour pageant that featured live performances by U.S. pop group Train and Nigerian-born Australian singer and dancer Timomatic.
Contestants must be aged between 18 and 27, unmarried and with no children.
The contest was broadcast live on U.S. television from the Planet Hollywood hotel and casino in Las Vegas and seen by an estimated 1 billion viewers on TV and online in 190 countries, organizers said.
Culpo will travel the world for the next year representing the Miss Universe Organization and a charity of her choice.
After reaching the top five, Culpo was asked to name one thing she would never do again. “Picking on my siblings growing up,” she replied.
The contest, owned jointly by businessman Donald Trump and the NBC network, held a moment of silence for the 20 children and six staff gunned down at an elementary school in Newtown, Connecticut, on Dec. 14.

Ms. Philippines Janine Tugonon is first runner up in Ms. Universe 2012
Bataan native Janine Tugonon came in as first runner up in the Miss Universe pageant 2012, placing second to Miss USA.
Making up the Top 5 in the pageant held in Las Vegas, Nevada, were Venezuela, Brazil, Philippines, USA, Australia.
Fourth runner up was Ms. Brazil. Third and second runner up were Australia and Venezuela respectively.
First runner up: Philippines. Tugonon improved upon last year's second runner up placing of Shamcey Supsup. In the year previous that, Venus Raj was third runner up.
This is the seventh time in the history of the pageant that the home candidate won Miss Universe - and the sixth time for the USA to accomplish the feat.
In the question-and-answer portion, Tugonon was asked: "As international ambassador, do you believe that speaking English should be a prerequisite for Miss Universe?"
She replied, "I don't think speaking English is about speaking a specific language. Being Miss Universe is about being able to influence and inspire people, regardless of language."
An online poll may have given Miss Philippines a big boost. The contestant with the highest number of votes was rewarded with an automatic spot in the semifinals round.
Ms. China won the award for Best in National Costume.
Considered an early favorite in the race because of her extensive exposure so far in talk shows and charitable activities like the “Art for Auction” event which benefited the non-profit organization Cure 4 The Kids, Janine is also known for her now famous “cobra walk” that could lead her all the way to the Miss Universe crown.
A native of Orion, Bataan, Janine actually placed first runner-up in last year’s Binibining Pilipinas pageant which was won by Shamcey Supsup, who went on to finish third runner-up in that year’s Miss Universe competition.
Janine decided to join the Bb. Pilipinas pageant again this year, to the mixed reactions of her own family. Given that Janine once rescued her sister’s cell phone from a mugger, she is certainly not the type who easily gives up and backs down from a challenge.
Fortunately, the second time turned out to be a charm as the determination of the 23-year old Pharmacy graduate paid off when she finally won the title and the right to represent the country in this year’s Miss Universe pageant.
With the back-to-back impressive showings of Shamcey and Venus Raj who placed fourth runner-up in Miss Universe 2010, expectations were naturally high for Janine to duplicate, if not surpass, the Top 5 finishes of her two predecessors, who have also served as her mentors for this year’s tilt.
Janine was also up for two other special awards in the pageant namely Miss Congeniality (formerly called Miss Friendship) and Best National Costume where she paraded a Muslim-inspired gown.
Earlier, the Miss Photogenic title was awarded to Miss Kosovo Diana Avdiu.

Sam Donaldson Arrested for DUI
Sam Donaldson may be known for reporting information, but on Dec. 1 he made some news of his own.
The ABC News veteran, 78, was arrested around 8 p.m. on Dec. 1 for driving under the influence in Lewes, Del., Police Chief Jeffrey Horvath confirmed in a statement to PEOPLE on Wednesday.
Cooperating with authorities by taking an Intoxilyzer test, the journalist was then released to an adult pending an appearance in court.
Donaldson was initially pulled over for a traffic violation, but after further investigation, it was apparent he had been drinking.

Obama is - once again - TIME's 'Person of the Year'
NEW YORK - Time magazine on Wednesday named the recently re-elected US President Barack Obama as its person of the year for 2012 -- the second time it has accorded him this honor.
Obama now not only has a reelection as America's first black president and a Nobel peace prize under his belt, but he beat fancied runners-up, including brave Pakistani girls' rights activist Malala Yousafzai, to be enshrined again as Time's dominant personality of the year.
The venerable American news magazine put Obama on its cover, striking a thoughtful, statuesque pose, and said he deserved the accolade as "the symbol and in some ways the architect of this new America."
The magazine lauded Obama's campaigning prowess, noting he was the first president since Franklin Delano Roosevelt to win more than 50 percent of the vote in two straight elections and the first president since 1940 to be re-elected despite a jobless rate above 7.5 percent.
Obama beat Republican Mitt Romney soundly in November's election to win a second four-year term, despite presiding over a chronic economic slump.
"In 2012, he found and forged a new majority, turned weakness into opportunity and sought, amid great adversity, to create a more perfect union," said Time, which had named Obama person of the year back in 2008 when he became America's first black president.
The others considered for the weekly magazine's traditional annual honor were Apple CEO Tim Cook, atomic scientist Fabiola Gianotti, and Egypt's post-revolutionary President Mohamed Morsi.
But Obama swept to the head of the pack because of what Time said was his ability to grasp the demographic and social changes shifting the United States.
"The truth is," Obama told Time, "that we have steadily become a more diverse and tolerant country that embraces people's differences and respects people who are not like us. That's a profoundly good thing. That's one of the strengths of America."

Instagram backtracks after move to sell users' pics triggers online uproar
Instagram backed down Tuesday from a planned policy change that appeared to clear the way for the mobile photo sharing service to sell pictures without compensation, after users cried foul.
"The language we proposed also raised questions about whether your photos can be part of an advertisement," Instagram co-founder Kevin Systrom said in a blog post.
"We do not have plans for anything like this and because of that we're going to remove the language that raised the question," he continued. "To be clear: it is not our intention to sell your photos."
Changes to the Instagram privacy policy and terms of service set to take effect January 16 had included wording that appeared to allow people's pictures to be used by advertisers at Instagram or Facebook worldwide, royalty-free.
Twitter and Instagram forums were abuzz over the phrasing, as users debated whether to delete their accounts before the new rules kicked in.
"Bye-bye Instagram," tweeted Scott Ninness. "Who in their right mind will use a service that allows your images (to) be sold with no financial remuneration to you?"
"Everybody should continue using Instagram but just take blurry photos of sandwiches," suggested a Twitter user with the screen name Michele Catalano.
Systrom did not specify how the terms of service wording would be changed.
Originally proposed portions of the new policy that rankled users included "You hereby grant to Instagram a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the content that you post on or through the service."
The terms also stated that "a business or other entity may pay us to display your username, likeness, photos, and/or actions you take, in connection with paid or sponsored content or promotions, without any compensation to you."
Instagram contended that it was not claiming ownership of people's pictures.
"Our intention in updating the terms was to communicate that we'd like to experiment with innovative advertising that feels appropriate on Instagram," Systrom said.
"Instead it was interpreted by many that we were going to sell your photos to others without any compensation. This is not true and it is our mistake that this language is confusing."
Some people tweeted in defense of Instagram, arguing that it was a "mega-business" that needs to make money.
"I quit Instagram on principle," Twitter user Liz Heron said on the popular message service. "I'm tired of contributing to the commodification (sic) of my own existence."
Instagram said that the changes were part of a move to better share information with Facebook, which bought the company this year.
Internet rights activists at the Electronic Frontier Foundation had called on Instagram to reconsider the new policy, saying it violated "key principles" for social networking services.
Instagram, which has some 100 million users, is seeking to route photo viewers to its own website, where it has the potential to make money from ads or other mechanisms.
This month, the service made it impossible for Internet users to view its images in messages at Twitter.
Previously, Instagram pictures shared in messages tweeted from smartphones could be viewed unaltered at Twitter.
Twitter responded by adding Instagram-style photo sharing features of its own.
Yahoo! joined the fray last week by making it more enticing for iPhone users to use its Flickr photo service.
Instagram rose to stardom with the help of Twitter, but has distanced itself from the messaging service since Facebook completed its acquisition of Instagram in September.
The original price was pegged at $1 billion but the final value was less because of a decline in the social network's share price.

Race is on for Philippine telcos’ mobile LTE in 2013
MANILA, Philippines — The country’s two largest telcos are prepping their network to go full-blast with LTE deployment next year, as the introduction of high-speed connectivity for smartphones, and not just data devices, commences at the tail-end of 2012.
Both Smart Communications and Globe Telecom said during their recent product launches that they will be ramping up the activation of LTE in their cell sites across the country, with a key focus on expanding outside of Metro Manila, where the high-speed Internet service is currently limited.
The topic of mobile LTE recently became a point of discussion as the two telcos launched Apple’s latest smartphone, the iPhone 5, but without the LTE feature enabled. Instead, Smart and Globe announced the availability of Android-powered smartphones that will be available — and will run–on their LTE networks.
Smart’s President and CEO Napoleon Nazareno told reporters during the company’s iPhone 5 launch that they intend to grow their LTE base to 1,000 cell sites by the first quarter of next year, up from just about 600 sites at the end of 2012.
“But the location would still depend on demand. We’re looking at focusing on key urban cities such as Cebu, Davao, Iloilo, Bacolod, and Pampanga,” Nazareno said.
Currently, Smart’s LTE service is available in 10 Metro Manila cities, which include Makati, Taguig, Mandaluyong, Pasig, Pasay, Muntinlupa, Manila, San Juan, Quezon City and Las Pinas.
Meanwhile, Globe’s Senior Advisor for Consumer Business Peter Bithos said their LTE network “is ready” in light of the telco’s recent network modernization initiative, which saw Globe overhauling its entire infrastructure to make it “future-ready.”
Bithos added that they are looking at expanding LTE coverage in Cebu and Davao, where their network upgrade has already been completed, aside from the availability of the service in Makati this year.
LTE pricing
The Globe executive added that they will not be differentiating their LTE price points, for example: when Apple finally decides to give the go-signal for LTE in the iPhone 5, since he said doing so would only “confuse the user.”
“We will not be differentiating LTE pricing from normal data plans, since that would create confusion among consumers,” said Gil Genio, head for international and business markets at the Ayala-led telco. “Mobile users don’t care which kind of network they’re on, so there’s no point in having different rates.”
Smart’s Postpaid Business Head Kathy Carag, meanwhile, said of their iPhone 5 LTE plans: “We will advice one LTE for iPhone [5] is ready.”
Currently, LTE services from both Smart and Globe are priced at a higher tier than mobile Internet plans that run on previous-generation 3G and HSPA networks, presumably due to LTE’s higher-bandwidth offering, which could theoretically shoot up to as much as 100 Mbps.
Smart’s Ramon Isberto said that the intensifying competition between the two major telcos will only “drive more affordable plans” for next-generation mobile Internet.
“We also see that medium-priced smartphones will start to enter the market next year, which will only drive demand for LTE,” Isberto added.
Touted as the next evolutionary step in mobile networks, LTE, also known as Long-Term Evolution, promises downlink speeds of up to 100 Mbps and a more efficient management of network traffic. Both telcos, however, cap their current LTE services at 42Mbps.
